NESA (Nexus Elites Sports Academy) Informed consent and risk tolerance agreement warning! By signing the document, you assume certain risks and responsibilities. Please read carefully! 1. This is a binding legal agreement. Address any questions or concerns before signing. As a participant in activities, programmes, courses, services and events sponsored or organized by NESA, its affiliated regions, leagues, clubs and teams (collectively referred to as the “Organisation”) and the sport , including but not limited to: games, tournaments, practices, training, coaching Personal, floor training, use of strength training and fitness equipment, machines and facilities, nutrition and diet programs, mentoring or coaching sessions or hours, aerobic and anaerobic conditioning programs (collectively, “Activities”) The undersigned, as Participant and Participant’s parent/legal guardian ( Collectively referred to as the “Parties”), you acknowledge and agree to the following terms and conditions set forth in this Agreement: Authorization for Photo Release Form for Minors. The NESA Academy has my permission to publicly use my child’s photograph or video to promote the NESA. I understand that images may be used in print publications, presentations, websites, and social media. I also understand that no royalty, fees, or other compensation shall become payable to me because of such use.Liability and Indemnity: The photo owner warrants that they own the rights to the photo(s) and that its use will not infringe on any third-party rights. The photo owner agrees to indemnify and hold [NESA] harmless from any claims arising from the use of the photo(s). 2. I am the participant's parent/guardian and bear full legal responsibility for the participant's decisions. Description of risks: 3. The parties understand and acknowledge that: A - Activities involve inherent foreseeable and unforeseen risks, hazards and dangers that no amount of care, caution or skill can eliminate, including, but not limited to, the possibility of serious bodily injury, permanent disability, paralysis and death; b) - The organization may offer or promote online programs (such as webinars, teleconferences, workshops and online training) that involve foreseeable and unexpected risks unlike in-person programs; c) - The organization faces the difficult task of ensuring safety and is not infallible. The organization may not be aware of the participant's fitness or abilities, may provide incomplete warnings or instructions, may make errors in judgment of weather or environmental conditions, and equipment used may malfunction; And d) - The World Health Organization has declared the new coronavirus (COVID-19) a global pandemic, and coronavirus (COVID-19) is considered highly contagious. The organization has taken preventive measures to contain the spread of the Coronavirus (COVID-19); However, the organization cannot guarantee that a participant will not be infected with Coronavirus (COVID-19). Additionally, participating in activities may increase the risk of contracting coronavirus (COVID-19). 4. The participant participates in activities voluntarily. In consideration of such participation, both parties hereby acknowledge that they are aware of, and may be exposed to, risks, hazards and dangers. Risks and dangers include.
